Introduction

This page (together with the documents referred to on it) tells you the terms and conditions on which We supply any of the products ("Products") listed on our website (www.sor.org) ("the Website") to you.  

Please read these Terms and Conditions of Sale carefully and make sure that you understand them, before ordering any Products from the Website.  You should understand that by ordering any Products, you agree to be bound by these Terms and Conditions of Sale.

You should print a copy of these Terms and Conditions of Sale for future reference.

Please understand that if you refuse to accept these Terms and Conditions of Sale, you will not be able to order any Products from the Website.

These Terms and Conditions of Sale do not apply to the following:

  • Events. The terms and conditions applicable to events can be found here: http://events.sor.org/registrations/terms_conditions
  • Qualification registration - A copy of the application form to register for a post graduate award in mammography is available on request.
  • Duplicate diploma - Members seeking a duplicate diploma are asked to provide a sworn affidavit confirming their name, name at time of qualification (if different), year of qualification and reason for loss.
  • Any other qualification.


About Us

The Products are sold through the Website by the Society of Radiographers.  "We", "Us" and "Our" mean the Society of Radiographers Limited, registered in England and Wales, company number 00169483 and the College of Radiographers, registered in England Wales, company number 01287383. Our registered office is 207 Providence Square, Mill Street, London SE1 2EW.Our VAT number is 234 9654 41.


Prices

Products are charged at the price shown on the product pages on the date you place the order. All prices are inclusive of VAT at the applicable rate where appropriate. Prices are correct at time of publication.

Orders will be processed at Our published prices, or in the case of any increase in price, you will be informed and given the opportunity to cancel your order.

We will normally verify prices as part of Our dispatch procedures so that, where a Product's correct price is less than Our stated price, We will charge the lower amount when dispatching the Product to you. If a Product’s correct price is higher than the price stated on the Website, We will normally, at our discretion, either contact you for instructions before dispatching the Product, or reject your order and notify you that We are rejecting it.

If the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as an error, We do not have to provide the Products to you at the incorrect (lower) price.


Ordering Online - Order Acceptance & Contract

After placing an order, you will receive an e-mail from Us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to Us to purchase a Product.

We are not bound by your offer to purchase a Product until We have sent you an order confirmation by email.

If a Product is not in stock, We will either let you know at the time of ordering or as soon after the order has been placed as possible.

We accept orders from most overseas and all BFPO addresses.  Please note that any tax, import or export duties are your responsibility and must be paid by you. For international orders, VAT will be deducted as appropriate. 

If you live outside the United Kingdom, you must not place an order if doing so would be a breach of any local, regional or national law. 

Please also note that you must comply with all applicable laws and regulations of the country for which the Products are destined. We will not be liable for any breach by you of any such laws.


Ordering Online - Security

We are committed to protecting your privacy and personal details. We comply with all of the applicable data protection laws. Please see our Privacy Policy for more details

We have put in place appropriate electronic procedures to safeguard the information that We collect. We use reputed payment partners to process orders. All transactions use encryption technology to protect your personal data. However, due to the open communication nature of the Internet, We cannot guarantee that communications between you and Us, or information stored on Our servers, will be free from unauthorised access by third parties.


Delivery

Shipping and handling charges are based on the weight of the item and the shipping destination and therefore vary. These charges will be calculated when you go to the check out. You may still cancel the order at this stage. We deliver your order directly via Royal Mail or other suitable carrier.


Cancellation

You may cancel an order for a Product at any time within seven working days, beginning on the day after you received the Product.  In this case, you will receive a full refund of the price paid for the Product. 

To cancel the order, you must inform Us in writing and return the Product to Us promptly (and at your cost) in the same condition in which you received it. You are obliged to take care of the Product whilst it is in your possession.

This does not affect your statutory rights.


Returns, Replacements and Refunds

If you exercise your right to cancel within the seven working day period referred to above, any money that you have paid for your order will be refunded.

If you would rather have replacement Products, We can arrange for delivery to you (subject to Our agreement); this constitutes a separate contract between you and Us and the delivery charges will apply in the usual way.

We will pay your reasonable costs in returning any Product to Us which is damaged or defective.

We endeavour to process postal return refunds/exchanges as soon as possible, but please allow up to 21 days for Us to do this.

Ownership and Title

The Products will be your responsibility from the time of delivery.

Ownership of a Product will only pass to you when We receive full payment of all sums due in respect of that Product, including delivery charges.


Warranties

We warrant to you that any Product purchased from Us through Our site will, on delivery and for the following 12 months, conform in all material respects with its description on the Website or in any documentation delivered with the Product, be of satisfactory quality, and be reasonably fit for all the purposes for which products of that kind on the Website or in any documentation delivered with the Product are commonly supplied.


Liability

We do not exclude or limit Our liability for:

  • Death or personal injury caused by Our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982.
  • Defective products under the Consumer Protection Act 1987.
  • Any other matter in relation to which it would be illegal for Us to exclude or attempt to exclude our liability.

Subject to the above, Our total liability to you shall be limited to the price of the Products ordered by you. This paragraph does not apply if you are a consumer.

If any part of these Terms and Conditions of Sale is unlawful, void or for any other reason unenforceable, then that provision shall be cut out of the Terms and Conditions of Sale and shall not affect the validity or enforceability of any of the remaining provisions.

If We fail to enforce a right under these Terms and Conditions of Sale, it does not mean that We do not have the right to enforce other rights, or the same right at a later stage.

No part of these Terms and Conditions of Sale are enforceable by anyone other than by Us and You.

If we should receive a complaint about any part of Our service then it will be dealt with promptly (we aim to reply within 5 working days).


Force Majeure

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by a Force Majeure Event.

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond Our reasonable control and includes in particular (without limitation) the following:

  • Strikes, lock-outs or other industrial action (but any industrial action by Our own staff shall not constitute a Force Majeure Event);
  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
  • Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
  • Impossibility of the use of public or private telecommunications networks;
  • The acts, decrees, legislation, regulations or restrictions of any government; and
  • Pandemic, epidemic, avian flu, swine flu, or the prospect of any of these events occurring.

Our performance under these Terms and Conditions of Sale is deemed to be suspended for the period that the Force Majeure Event continues, and We will have an extension of time for performance for the duration of that period.  We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which Our obligations under these Terms and Conditions of Sale may be performed despite the Force Majeure Event.

You may cancel an order for a Product which has not been delivered because of a Force Majeure Event.  In this case, you will receive a full refund of the price paid for the Product.


Law and Jurisdiction

The English courts have exclusive jurisdiction over any claim arising from, or related to, the Products and these Terms and Conditions of Sale.  Any dispute or claim arising out of or in connection with the Products or these Terms and Conditions of Sale or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. This paragraph is subject to the paragraph below.

We may enforce our rights in your country of residence or any other relevant country.


Notices and other communications

Applicable laws require that some of the information or communications We send to you should be in writing.  When using the Website or ordering Products, you accept that communication with Us will be mainly electronic.  We will contact you by e-mail.  For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that We provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

All notices given by you to Us must be given to Society of Radiographers at 207 Providence Square, Mill Street, London SE1 2EW. We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any of the ways specified in the paragraph above. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.
